Judge Robert J. Shelby, whom President Barack Obama appointed to the U.S. District Court in Utah last year, issued an opinion on Friday declaring that a right to same-sex marriage is “deeply rooted in the nation’s history and implicit in the concept of ordered liberty.”
Shelby was confirmed to the federal bench by a voice vote of the Senate on Sept. 21, 2012. There was no debate over his nomination, and no senator objected to his confirmation.
He has now issued an opinion that could fundamentally alter American law and culture.
“The State’s second argument is that the Plaintiffs are really seeking a new right, not access to an existing right,” Shelby wrote in an opinion issued on the afternoon of the Friday before Christmas.
“To establish a new fundamental right, the court must determine that the right is ‘deeply rooted in this Nation’s history and tradition’ and ‘implicit in the concept of ordered liberty,’ such that ‘neither liberty nor justice would exist if [it] were sacrificed,” he said.
This unanimously-confirmed, not-debated-on-the-Senate-floor, Obama-nominated judge then proceeded to do that just that.

This is all true and sure. Those who practice unnatural sex are seven times more likely to be drug addicts, six times more likely to commit suicide, three times more likely to be alcoholics.
Those who practice unnatural sexual acts murder themselves and those they tempt. God loves His creation, and warns them so they would not choose to do such vile things.
The gay marriage issue is a deliberate misdirection, a smoke screen, created to hide behind, in an attempt to sway opinion. We must point to the actual point of “unnatural sex” and what the Bible says happens to those who practice it. The evidence of what is hoped for are in the real life statistics.

They also thought a black human was worth 3/5 of a white human. They were brilliant men, but limited by the prejudices of their time.
Shelby is an Iraq war veteran recommended to the office by Sen. Orrin Hatch (R-Utah).
Stating a fact about capital offenses is not a comment. Desertion, cowardice, treason and homosexuality were the only four capital offenses on a federal level. All other criminal offenses were to be handled on a state level.
Your next mistake was to make a straw man argument: switching from unnatural sexual relations to slavery. If you would do a little research, you would see that the Northern legislators fought for the 3/5 ruling. The Southern legislators wanted to give blacks 100% in order to have a larger population count which would give them more representation in Congress.
