Under federal law, employers and universities cannot legally mandate COVID vaccines because they are unlicensed Emergency Use Authorization products which are, by definition, experimental.

Holland and Glaser wrote:
“If a vaccine has been issued EUA by the FDA, it is not fully licensed and must be voluntary. A private party, such as an employer, school or hospital cannot circumvent the EUA law, which prohibits mandates. Indeed, the EUA law preventing mandates is so explicit that there is only one precedent case regarding an attempt to mandate an EUA vaccine.”

Great find. The problem with all this is, when has the “law” stopped stupid or evil doers? This is just another fork in the road to serfdom in my opinion. Do you think for one minute these ass-hats haven’t war gamed this issue.
The pertinent section 21 U.S.C. § 360bbb-3(e)(1)(A)(ii) states:
(ii) Appropriate conditions designed to ensure that individuals to whom the product is administered are informed-
(I) that the Secretary has authorized the emergency use of the product;
(II) of the significant known and potential benefits and risks of such use, and of the extent to which such benefits and risks are unknown; and
(III) of the option to accept or refuse administration of the product, of the consequences, if any, of refusing administration of the product, and of the alternatives to the product that are available and of their benefits and risks.
I work for the Federal Government and we are mandated to wear masks while indoors/in facility. My guess is that the “consequences” of refusing administration of the product (i.e., wearing our masks while indoors) is being fired.
Now what?

Remember…..ethics, morals and most importantly THE RULES simply do not apply to the left. You CANNOT quote rules to stop them from abusing you because they DON’T have to follow any rules. They’ve proven that repeatedly over the past few decades.
Hm. I would have said the Fourth Amendment to the Constitution prohibits mandates of anything body-invasive. In my reading of that document, I have found no “escape clauses” for “emergencies.” So why is it necessary to cite some lesser statute?

Certainly something to keep an eye on as to how it develops. It’s easy to suspect there is an element like this to it so good to keep an eye on this.
Employers are going to be More Afraid of the ‘government’ harassing them to “Mandate” ‘vaccination’ than they are of a Fired Employee being able to afford the kind of Lawyers that would be a Threat to them. Never Mind how the (((courts))) would dismiss any such Case as being “Without Standing”.
IF this were a Viable Path to ‘Bringing them to Heel” you would already see Ads on T.V. by Law Firms looking to ‘Class Action” this issue. I look at it as that ANY ‘mandate’ by ‘government’ for me to be a Lab Rat in a Medical Experiment is a Violation of My Human Rights -- and thus Killing those attempting to ‘Force’ Me to participate is Self-Defense.
None of that matters if the company is in a Federally Inspected/Controlled industry. The Feds have mandated vaccines plus masks for what my company does so it was either get poisoned or fired.
