Publius Huldah: You Better Open Your Eyes

Dear Friends,

Those pushing for an Article V convention assure you that Delegates to a convention can be controlled by State laws.  But that is not true.  Delegates to such a convention are the Sovereign Representatives of The People and have the inherent sovereign power to throw off our Form of government and institute a new Form of government (Declaration of Independence, 2nd para).

Our Form of Government is our Constitution of 1787 – it is our 2nd Constitution.

Our 1st Constitution was the Articles of Confederation.

How did we get from our 1st Constitution to our 2nd Constitution?

There was a convention to propose amendments to our 1st Constitution.

The result of that convention was a new Constitution with a new method of ratification.  Whereas all 13 of the States had to approve amendments to our 1st Constitution; Article VII of the 2nd Constitution provided that it would be ratified by only 9 States.

PEOPLE!  You better open your eyes.  Or you will wake up one day and find that a 3rd Constitution has been imposed – and you will not like it.

This short paper shows why Delegates to an Article V convention can not be controlled by State Laws:

There is a safe way to smack down the federal government:  LEARN and ENFORCE the Constitution of 1787 we already have!  We have been ignoring it for 100 years:  THAT is the problem.

I would rather hear you advocate for restoration of the Articles of Confederation and Perpetual Union … the first “constitution”.

The second constitution is merely a framework that established and ordained the growth of central / national tyrannical government. The only praiseworthy attribute of the second constitution were the first ten amendments.

The ‘wisdom’ of the latter amendments brought us such benefits as anchor-babies, loss of the Senate to ‘democracy’, direct taxation, prohibition, …

Need I say more ?

Some of those Amendments that you mentioned where not legally ratified. The real reason we have what we have today is because the People did not stand up and demand that the Constitution be followed.

I agree on the problems inherent in an Article 5 convention. Those wanting change have two viable recourses: 1) enforce the existing, 2) Amend the existing. All other approaches are perilous!

Does any one know who Publius Hudah is? The only thing I could find about her she doesn’t go buy her name. The only place I can find the word was attached to one of the signers of the US Constitution. wonder why no one no’s her real name seen her birth certificate. Starting to smell like the President. I Wonder if she is another Jones Town

I have read her work that David has posted here for a few years, and I agree with her. I don’t think there is anyone in this government intelligent enough to improve on the Constitution and the Bill of Rights AS THEY ARE ORIGINALLY WRITTEN. I don’t trust ANY politician in this day and age to do what is right for this Country; they are in it only for their own personal benefit.

What a pant load! An article 5 meeting of the states can DO nothing other than make proposals. They can propose amendments to require everyone to live in mud huts but three fifths of the states would have to approve in order to start building your new hut. Think that’s likely? Of course not.

The article 5 process was put in place by the founders precisely to meet the situation we currently find ourselves in; an out of control federal government which WILL NOT restrain itself from its tyranny. It is the last non- violent constitutional remedy before armed revolt is required.

Listen, we are in dire straits and this is a constitutional process. Educate yourselves by reading the founders own words regarding the importance of this process. The process is one of the state legislatures who are closest to the people. That’s the whole damn point. You as a citizen have far more ability to influence this process because those state legislators are close. They can’t insulate themselves in Washington. You can get to them and retain a measure of influence and control not otherwise possible.

Think for yourselves, educate yourselves. The republic depends on it.

I have a question for the all the Article V convention supporters. Who will enforce the new laws? The government, law enforcement, the military, maybe The People? No one on that list enforces the Constitution now, so what makes you think they will enforce the new laws.

You want freedom? Then stand up and enforce the Constitution.
