While the TEA Party Sleeps

This is part 2 of a General Assembly(GA) meeting of the people (occupiers) held in Raleigh in front of the state Capitol building on October 15, 2001. The facilitator is Daniel Buck from Apex, NC (http://www.youtube.com/watch?v=Ioam-WeenaA).

After the agenda was approved, the Committee Reportback from their Legal Committee outlined their plans.

  1. The legal counsel is currently negotiating with city officials. They are hoping that the ultimate results of these negotiations will be better than what is being asked for.
  2. Negotiations with state officials may require some political muscle. They are developing an argument with legal precedent to apply for a permit to use the Capitol grounds. If this does not work, they will apply political pressure. Members were urged to contact sympathetic politicians to advance their requests.
  3. Options in play for staying at the Capitol:
  • Use Capitol grounds as a campsite
  • Compromise until the state can become comfortable with the occupation. Then ask for more.
  • The most simplistic is to continue to use the sidewalk and the Capitol Plaza on the south side of the Capitol

Additional options include applying for two permits per day for short periods (two hours). The first would be at noon with daily speakers from the Universities who will give lectures relevant to the occupation.

A plan to set up a small tent could be used as a legal precedent. I suspect this means squatter rights or the ability to then add more tents if they set up one tent.

The second permit would be at 6:30 PM to allow more space for General Assembly meetings.

These permits would go for a week to establish a better working relationship with the State. These plans would still be concurrent with occupying the sidewalk.

A report on the people who were arrested was given. These people are their “champions” but they are prohibited from Capitol grounds for any future events until charges are dismissed or a judge grants them access.

It’s over. We argue and debate back and forth about such mundane things while this administration continues to button down their forces to get complete control. Meanwhile no one does a damned thing about it. Are you still flying while TSA gropes your children? Why? They are now at every truck stop in Tennessee (the perfect state to do this in BTW, since no official there will complain) checking without warrants, every truck they choose. The Patriot Act (which also gets no complaints) is responsible for allowing this. Then they tell the drivers to report anything suspicious they observe. Folks, we are living Germany in the 30s, Russia through the 70s, China even now. They already have total control of us since rather than actually stopping this government, everyone goes on marches and campouts and sings songs or beats drums or has “VIPs” give “profound speeches about freedom and liberty. We are living the take over and downfall of the U.S. This is what it looks like. Take notes so that if you are alive you can talk about it secretly to your grandchildren then they can turn you in to the police!

You will notice that the DMV officials stand with the TSA people to enforce their actions. Tina, I hate to be the bearer but that is all I am, not the enforcer, but your preparations will go for naught as they come in the night and take you away. I keep asking this question and have yet to get any kind of answer. People tell me they will die before they are taken away. “When the police come in the middle of the night to your door, will you shoot them?” I think everyone will answer the same, “of course not.” That is the way it’s done folks. We are living the history. The Germans biggest problem was shuffling the crowds into overfull cars, not resistance. The Cambodians simply went down the streets rounding up whom they decided should die. And trust me, they will have no problem finding candidates to take the people to the camps or the killing fields. These demonstrations are working completely into the enemy’s hands. While we fuss with one another about rights, etc. they continue to build a force of willing participants. And as they continue to dismantle the nation, they get more and more participants who yearn for a job for food.
Yes, I agree that preparations must be made. But I also think we need to force ourselves on the elected state officials to stop the feds at the border. The only problem, IMHO, they don’t have the fortitude to do that. Also, every sheriff in this state has the power to stop this nonsense at his county borders but, again, they won’t.
How many of the GOP candidates that are running have talked about repealing the Patriot Act, the most insidious bill ever passed by a U.S. Congress? None! That, I’m afraid, is your answer.

No argument that needs to happen, but don’t withhold your oxygen waiting for our NC “General Abdication” to act as it should.

Early in 2010, I sent an email to Senator Neal Hunt and requested the NC General Assembly behave in accordance with the philosophy of the Kentucky and Virginia Resolutions… to conduct nullification and interposition where appropriate.

The text of that email follows. I’m still listening to the crickets chirp.

Expectations for members of the NC legislature:

In the Kentucky Resolutions of 1798, Thomas Jefferson wrote in response to the hated Alien and Sedition Acts:

“The several states composing the United States of America are not united on the principle of unlimited submission to their general government”

and

“where powers are assumed [by the federal government] which have not been delegated, a nullification of the act is the rightful remedy: that every State has a natural right in cases not within the compact, to nullify of their own authority all assumptions of power by others within their limits: that without this right, they would be under the dominion, absolute and unlimited, of whosoever might exercise this right of judgment for them”

In short, nullification means this: The state is taking a position that a particular federal law is unconstitutional, and thus, the law in question is void and inoperative, or ‘non-effective,’ within the boundaries of that state; or, in other words, not a law as far as that state is concerned.

But nullification is much more than just mere rhetoric. To nullify a federal law in practice requires active resistance to it by the people and the state government.

INTERPOSITION

In the Virginia Resolution of 1798, James Madison wrote of the principle of interposition:

That this Assembly doth explicitly and peremptorily declare, that it views the powers of the federal government, as resulting from the compact, to which the states are parties; as limited by the plain sense and intention of the instrument constituting the compact; as no further valid that they are authorized by the grants enumerated in that compact; and that in case of a deliberate, palpable, and dangerous exercise of other powers, not granted by the said compact, the states who are parties thereto, have the right, and are in duty bound, to interpose for arresting the progress of the evil, and for maintaining within their respective limits, the authorities, rights and liberties appertaining to them.

Here Madison asserts what is implied in nullification laws – that state governments not only have the right to resist unconstitutional federal acts, but that, in order to protect liberty, they are “duty bound to interpose” or stand between the federal government and the people of the state.

This is the pressure from below with Obama et. al. being the pressure from above. It’s not a new tactic but a very old and much used one. The drive here is to get the mainstream (tea party, if you will) to respond. There is absolutely no need to respond. These individuals are self destructing every time a video is show with them chanting like mindless monkeys. I personally won’t waste my time camping in a public square. There are other ways we can expend our very limited resources. Let the unions, Soros foundations, and other liberal establishments spend their money. The danger is that the mainstream elects a “savior” like Romney or Cain and goes back to sleep thinking all is won. Reality and history says otherwise since it has taken both parties and a host of conservatives like Reagan, Gingrich, McCain, and others working in concert with liberals like Clinton, Pelosi, Reid, Frank and others to get us were we are today. More government will not solve the problems of too much government. Remember, everything Wall Street did, they did so with complete complicity and approval of our government.

You might want to check out this site. There will be a serious rally in D.C. on 11-11-11, Veterans Day, not by Tea Partiers, 912ers, etc. but finally by a group that I think is about to restore this country. They have laid out a no-nonsense declaration which, when read, one realizes will never be followed so I believe they will move to the next stage. With the Feds turning off all TV and radio stations on Nov. 9 supposedly as a test, the time has come, people. We are looking so much like the Soviet Union today that we had better get serious if we have any hope at all.
