We Need a Constitutional Amendment

From Grok:

Tom Fitton’s post references Article I, Section 9 of the U.S. Constitution, which allows suspension of habeas corpus—the right to challenge unlawful detention—only during rebellion or invasion if public safety demands it, a clause historically used in extreme cases like Lincoln’s Civil War suspension or against the Ku Klux Klan in 1871.

Fitton’s suggestion that Trump suspend habeas corpus to “reverse the Biden invasion” ties to criticisms of Biden’s immigration policies, which a 2024 House Oversight Committee report claims caused a border crisis with exponential increases in encounters and backlogs, accusing the administration of intentionally un-securing the border.

Suspending habeas corpus in this context would be unprecedented for immigration enforcement, as the writ’s historical use has been limited to wartime or domestic insurrections, not policy disputes, and could face legal challenges given the Supreme Court’s 2001 ruling in INS v. St. Cyr that the Suspension Clause protects the writ as it existed in 1789.

50 USC Chapter 3. Alien enemies act. POTUS does not need SCOTUS permission to expel aliens, period. He has mandate from electorate to do just that. Pick up the pace, is what I say, along with removing incentives to try to stay or any impediments to those who correctly choose to self deport.

I agree. Pick up the pace and show something is being done instead of constant posturing and bickering between lawyers and judges. So far all these deportations are of those invaders who broke federal law when they crossed the border AND are a substantial threat to public safety. Is it possible to suspend habeas corpus only for those who are not US citizens? Maybe it’s time for some “unprecedented” action on protecting our country.

Dittos. The current pace is nowhere near enough to remove the illegals here during the next twelve years, assuming administrations amenable to deportations, let alone the next four.

Non-cutizens, regardless of immigration status, do not receive benefits that citizens do!

So it’s just a policy dispute eh? Apparently 30 million illegals doesn’t rise to an invasion?
