What is the status of castle doctrine legislation in North Carolina? One piece of legislation has passed the third reading in the Senate (S34) but it was then relegated to the infamous Judiciary Subcommitte A on March 22nd. Although my Democrat representative is one of the main obstacles against preserving the 2nd amendment in our state, Deborah Ross should not be able to wield any power to stop HB 52 on the floor for a vote. However she is on the subcommittee that is withholding it from going to the floor.
Here is the short description of this important legislation:
February 9, 2011
A BILL TO BE ENTITLED AN ACT TO CLARIFY WHEN A PERSON MAY USE DEFENSIVE FORCE TO PROTECT AGAINST THE UNLAWFUL AND FORCIBLE ENTRY INTO THE PERSON’S DWELLING BY ANOTHER, TO PREVENT THE REMOVAL OF A PERSON AGAINST HIS OR HER WILL FROM THE PERSON’S DWELLING, AND TO PROVIDE THAT A PERSON IS JUSTIFIED IN USING DEFENSIVE FORCE IN THESE CIRCUMSTANCES AND SO IS IMMUNE FROM CRIMINAL PROSECUTION AND CIVIL ACTION FOR THE USE OF SUCH FORCE.
I have now attended three of this subcommittee’s meetings and I am not impressed with their work or progress. The agenda for their meeting on Wednesday, May 4th is presented below:
May 4th, 2011
JUDICIARY/A 1228/1327 10:00 am
H.B. 174 Commercial Real Estate Broker Lien Act.
H.B. 348 Offenders/No Access to Personnel Records.-AB
H.B. 379 Uniform Depositions and Discovery Act.
H.B. 380 Amend RCP/Electronically Stored Information.
H.B. 493 Landlord Tenant Law Changes.
H.B. 737 Strengthen Child Safety Laws/Care Facilities.
Here is a list of additional bills that this subcommittee is holding back. You decide if the Republican controlled House is doing the work that we elected them to do based on the May 4th agenda of this subcommittee versus the list of legislation presented in this article that they are holding back.
