The 14 th Amendment states that all persons born in the US, and who are….. “subject to the jurisdiction thereof”…. are citizens.
If a foreigner sneaks over our border, he/she entered without being “subject to the jurisdiction thereof”…. That foreigner did not submit himself/herself to the US jurisdiction by entering lawfully and acquiring a residency visa (commonly called a Green Card).
The children born of a parent who unlawfully entered are also present without being subject to the jurisdiction of the US because they earn their parent’s status at birth.
But it is all a murky mess because Congress has not enact laws that carry out the 14th’s criteria.
You can bet the elites and deep state will be all over this one, trying to defeat the Trump Team’s efforts. The Dems can’t do it legislatively though as the Republicans currently hold the house for the lame duck period. Soooo good -- hope it comes to pass.

and the solution is simple. baby is born, hospital issues certificate of live birth, prettty much like is done today. parents take certificate to county clerks office (in large cities, a branch office may be opened in the hospital so as to make it easy for parents) with proof of parents citizenship. if just like today, one parent is a U.S. citizen, the county clerk issues a birth certificate with U.S. citizen entered in citizenship box. if neither parent is a citizen, the citizenship of the parent(s) is entered.

I wish Trump could send every illegal back with the wave of a wand. The cost of doing so will be horrendous, however, and I expect that Republicans will defect to the Democrats on this issue.
The Supreme Court ruled in the 1800s that anyone born on US soil is a citizen. (I believe that there is an exception for children of foreign diplomats.) It is possible that the Supreme Court will overturn this precedent, but I doubt it. If Soto-Mayor leaves the court, the chances will increase.
What Trump can do is close the border, period. Republicans can ensure that the parents of anchor babies are not immune from deportation. (They simply take the kid with them, if they choose.) Republicans can pass a law making it a criminal offense with serious penalties to hire illegals (But they probably won’t. Too many Republican business owners, you see. Even the mild penalties now are not enforced.) Republicans can pass a law that bars federal aid of ANY type to sanctuary cities. Republicans can pass a law that bans ANY use of federal funds for illegal aliens. Republicans can also offer states and municipalities bounties for each illegal who is arrested and delivered to ICE. (But they won’t.) Republicans can appoint immigration judges that will place under very harsh scrutiny the spurious asylum claims of the overwhelming mass of illegals.
Pay Asset forfeiture with a bounty equal to 50% of the annual welfare payments each one receives, to each citizen turning in an illegal. Announce the program with a 30 day grace period,. Open up the south bound border gates. Should only take a couple of weeks, cost zero.
Amen Brother I am fed up with being forced to live next to a full-fledged drug running coyote! he heads to the border every other weekend and picks up a load of male workers who he pays poorly until they save enough money to buy a pickup while the pregnant women camp out in the kitchen patio garage area regardless of weather until it is time to dump them at the ER to give birth. When the guys make enough money, he hauls them down to the local auto auction to get a pickup truck and says congrats you’re a businessman now leave my house I have more coming in that need the space.
