In Marbury vs Madison Jefferson Saw the Beginning of Judicial Tyranny

After Sheriff Harrison’s attorney’s remarks concerning Marbury v. Madison, it appears that most people are unfamiliar with this ruling. It also appears that people that are familiar with it, are using it in a manner that is what Thomas Jefferson warned us about concerning judicial tyranny.

Judicial Tyranny Was Foreseen by Thomas Jefferson

Early in his career Jefferson was concerned for the independence of the judiciary in order that it be strong and to prevent injustice. However, when the federalists focused their efforts on the transfer to Washington of the power reserved in the Constitution to the States, using the power that they had obtained in the judiciary, he began to view with alarm the subversion of the judiciary and its independence of the nation. To the prevention of their objective Jefferson devoted the rest of his life. The following quotations may be found in Jefferson: Magnificent Populist, by Martin Larson, pp 136-142

I have little respect for our Supreme Court after their decision concerning the Affordable Health Care Act. Does anyone think this body is acting in the best interest of our Republic? If you do, I suggest you remember Justice Ginsburg’s thoughts on our Constitution that she gave to the Egyptian people. I have little respect for anyone who puts the rule of men over the rule of law.

Firearm Confiscation by Law Enforcement in a Nutshell

The video was filmed at the Moccasin Creek Minutemen meeting on the 2nd amendment in Zebulon, NC on January 17, 2013. Three North Carolina sheriffs  addressed a group of over 200 people who are concerned that the federal government will infringe upon our 2nd amendment rights. The consensus after the meeting is that we are now even more concerned about our right to bear arms. All three sheriffs (Donnie Harrison-Wake County, Jerry Jones-Franklin County and Carey Winders-Wayne County) assured the people that they would not confiscate our firearms. The reason: the federal government will not pass legislation restricting the 2nd amendment.

However, if Congress did pass such legislation, they would enforce the law and we must work through the legal or legislative system to change it. What Did Bob Schieffer Really Mean?

Consider Bob Schieffer’s comments concerning Lyndon Johnson and the civil rights’ movement after reading the following:

The following quotes are LBJ quotes:

“I’ll have those niggers voting Democratic for the next 200 years.” —Lyndon B. Johnson to two governors on Air Force One –

“These Negroes, they’re getting pretty uppity these days and that’s a problem for us since they’ve got something now they never had before, the political pull to back up their uppityness. Now we’ve got to do something about this, we’ve got to give them a little something, just enough to quiet them down, not enough to make a difference.”—LBJ

You can find this in Ronald Kessler’s “Inside The White House”.

The civil rights’ act passage was due to Republicans. Is Mr. Schieffer actually making a different point other than what most people think he meant? I doubt it. It never ceases to amaze me that even reporting this information makes people label me a racist. Are we not fighting for the principles of  “all men are created equal” and Liberty?

An Approaching Darkness

I attended the Moccasin Creek Minutemen Meeting tonight on the 2nd Amendment. Sheriffs Donnie Harrison (Wake County), Jerry Jones (Franklin County) and Carey Winders (Wayne County) gave opening comments and then answered questions. I appreciate their appearance at this meeting. All three sheriffs guaranteed that they would not take our guns away. Unless the government passed a law mandating their confiscation. But since the government would never do this (in their opinion), we can consider our firearms to be secure under the second amendment.

Let’s review what has transpired in our country. The right to private property has been infringed. New London, CT land owners and GM bondholders saw their property redistributed. J.P. Morgan took possession of people’s private financial accounts at M.F. Global. Was the law followed? According to the president and courts, nothing was done illegally in these cases.

The government now has the authority to force people to buy a product. In this case, the product is health care insurance. Does the government have the authority to mandate how you spend your money? According to the Supreme Court, it does have this authority as a “tax”. Really?

Bob Schieffer Likens Obama ‘Taking on the Gun Lobby’ to Hunt for Bin Laden, ‘Defeating the Nazis’

Bob Schieffer somehow topped Chris Matthews during CBS News’s special coverage of President Obama’s gun control press conference on Wednesday, as he became the worst caricature of a foaming-at-the-mouth cheerleader for the chief executive. Schieffer lauded “one of the best speeches I’ve ever heard him [Obama] deliver“, and compared Obama’s  new gun control agenda to Lyndon Johnson’s push for civil rights legislation in the 1960s.

The List of Executive Actions to Address Gun Violence

1. Issue a Presidential Memorandum to require federal agencies to make relevant data available to the federal background check system.

2. Address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, that may prevent states from making information available to the background check system.

3. Improve incentives for states to share information with the background check system.

4. Direct the Attorney General to review categories of individuals prohibited from having a gun to make sure dangerous people are not slipping through the cracks.

5. Propose rulemaking to give law enforcement the ability to run a full background check on an individual before returning a seized gun.

France in Mali fights the unfinished Libyan War

On January 11, a few hundred French troops and a handful of fighter jets and gunships launched a campaign against Islamist terrorists in Mali, a West African desert vastness larger than Texas and California combined. This former French colony appealed to Paris for aid to throw back a mixed al Qaeda-rebel advance on the capital, Bamako.

But France, no more than the US, had learned from the Afghanistan War that Al Qaeda cannot be beaten by aerial warfare – certainly not when the jiahdists are highly trained in special forces tactics and backed by highly mobile, well-armed local militias, armed with advanced anti-aircraft weapons and knowledgeable about conditions in the forbidding Sahara.

Within 48 hours, this modest “crusader” intervention had united a host of pro-al Qaeda offshoots and allies, some of them castoffs from the army of Libya’s deposed Muammar Qaddafi.

They are led by Al Qaeda in the Islamic Maghreb – AQIM; the West African jihadist MUJAO; and the Somali al-Shabaab which is linked to Al Qaeda in the Arabian Peninsula – AQAP. Together, they are threatening to execute one by one the 10 or eleven French hostages they are holding as part of their revenge on France.

Restoring Confidence in Japan

Faced with a stubbornly slow and uneven global economic recovery, more countries are likely to resort to cutting the value of their currencies in order to gain a competitive edge.

Japan has set the stage for a potential global currency war, announcing plans to create money and buy bonds as the government of Prime Minister Shinzo Abe looks to stimulate the moribund growth pace. (Read More: Japan PM Says BOJ Must Set 2% Medium-Term Inflation Goal)

Economists in turn are expecting others to follow that lead, setting off a battle that would benefit those that get out of the gate quickest but likely hamper the nascent global recovery and the relatively robust stock market.

1. This post has become the most read post on this site in four days.

2. The post has generated the most comments for any post on this site.

The second point should not be overlooked. A very small majority of people post a comment on an article. And in this case, over 98% of the comments are positive. LT  (and I agreed) is approving all comments. Only cursing is editing as in the case below. What is very interesting to me personally are that the comments are becoming part of the article’s purpose. Outside references to this article are actually telling people to read the comments after it.

The Time For Petitions Was Already Over

STOP FILING PETITIONS. No one is listening in Washington as shown by the fourfold increase to 100,000 signatures now required for the “white house” to issue a response. And we have already seen the type of response that is given.

Does the number of signatures on a petition matter? Does the petition matter? We should not be asking to have our rights and Constitution restored: we should be demanding that vain and aspiring men stand down.

The line between right and wrong has become distinct. WE MUST NEVER BEG FOR LIBERTY.

White House now requires ‘We the People’ petitions to have 100,000 signatures for official response

President Barack Obama’s deputies have quadrupled the number of signatures that petitioners on the administration’s “We the People” website must collect to get an official response from the White House, following a series of popular, provocative and disrespectful signature drives by his critics.

Some of the petitions sought approval for states to secede after Obama’s re-election, while others called on the White House to disavow executive orders that restrict gun rights, or to deport CNN’s British-born, progressive host Piers Morgan.

“Starting today, as we move into a second term, petitions must receive 100,000 signatures in 30 days in order to receive an official response from the Obama Administration,” said an early evening Jan. 15 statement from Macon Phillips, the White House’s digital strategy director.
